This privacy policy ("Policy") explains how BetterCare Ltd. (referred to as "BetterCare", "Better Care", "we", "us" or "our") collect, store and use information we collect, as well as personally identifiable information, as further described below ("Personal Information") of our users (referred to as "user", "you" or "your"), while using our App (the “App”) and content and services therein (collectively, "Services") and what rights you have should we process your Personal Information.

We use Personal Information to enable the App to provide the Services for which it is intended. We may also use your Personal Information to improve the App.

By using the App you agree to the collection and use of information in accordance with this Policy.
BY USING THE APP YOU DECLARE, WARRANT AND CONFIRM THAT IF YOU ARE PROVIDING AND/OR COLLECTING VIA THE APP INFORMATION, INCLUDING PERSONAL INFORMATION, OF A THIRD PARTY, THAT YOU ARE DOING SO AS THE LEGAL GUARDIAN OF SUCH OTHER THIRD PARTY AND/OR YOU ARE LEGALLY AUTHORIZED AND EMPOWERED TO PROVIDE AND/OR COLLECT SUCH INFORMATION, INCLUDING PERSONAL INFORMATION, OF SUCH THIRD PARTY AND/OR YOU RECEIVED THE FULL CONSENT OF SUCH THIRD PARTY TO PROVIDE AND/OR COLLECT INFORMATION, INCLUDING PERSONAL INFORMATION, OF SAID THIRD PARTY. IF YOU DO NOT HAVE SUCH AUTHORIZATION, YOU ARE NOT ALLOWED TO PROVIDE NOR COLLECT ANY INFORMATION, INCLUDING PERSONAL INFORMATION, OF A THIRD PARTY, AND YOU ARE NOT ALLOWED TO USE THE APP TO PROVIDE AND/OR COLLECT INFORMATION OF ANY KIND, INCLUDING WITHOUT LIMITATION, PERSONAL INFORMATION.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Policy:

  • Account means a unique account created for you to access the Service or parts of our Service. To this end, you are allocated a username and password that is unique to you. It is your responsibility to ensure the secrecy of the username and password. In the event that the username and/or password are disclosed, please contact us immediately at the contact detailed at the end of this Policy.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • App refers to the App operated by us, including the software program therein.
  • Company (referred to as either the "Company", "we", "us" or "our" in this Policy) refers to Better Care Ltd., an Israeli registered limited liability entity.
  • Device means any device that can access the App to obtain the Service such as a cellphone or a digital tablet.
  • Personal Information means any information that relates to an identified or identifiable individual.
  • Service refers to the services we offer via the App.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You and/or your means the individual accessing or using the App and/or Service, or the company, or other legal entity on behalf of which such individual is accessing or using the App and/or Service.

 

Collecting and Using Your Personal Information

Types of Data Collected

Personal Information
While using the App and our Service, we may ask you to provide certain personally identifiable information that is used as part of the Service. Personally identifiable information may include, but is not limited to:
  • Your email address
  • Your first name and last name
  • Your phone number
  • Usage Data on your device used to access the App and Service
 Usage Data
Usage Data is collected automatically when using the App and/or Service.
Usage Data may include information such as your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the in-App pages you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access the App and/or Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
We may also collect information that your browser sends whenever you visit our App and/or Service, or when you access the Service by or through a mobile device.
 

Information Collected While Using the App

While using the App, in order to provide some of the features in the App, we may access to your Device's camera and photo library.
 
We use this information to provide features offered by the App, as well as to improve and customize our App and/or Service. The information may be uploaded to our servers, or it may be stored on your Device.
 

Use of Your Personal Information

We may use Personal Information for the following purposes:
  • To provide and maintain the Service, including to monitor the usage of the App and Service, and to send you notifications on how to improve your use of the App and optimize the Services.
  • To manage your Account: to manage your registration as a user of the Service, and including without limitation, to send you billing invoices required by applicable law. The Personal Information you provide can give you access to different functionalities of the App and/or Service that are available to you as a logged-in user (i.e. through the username and password allocated to you when opening the Account).
  • To contact you: To contact you on your device, through the App, by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, or contracted services, including without limitation, to offer you additional and/or new services we and/or our third-party contracts may offer, as well as informing you of security updates, when necessary or reasonable for their implementation.
  • To manage your requests: To attend and manage your requests to us.
  • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing, and your experience.

We may share your personal information in the following situations:

  • With your employer: we may share your personal information with your employer, in connection with which the App used by you was first downloaded, and in connection with which, the username and password was allocated to you.
  • For business transfers: we may share or transfer your Personal Information in connection with, or during negotiations of, any merger, sale of Better Care’s assets, financing, or acquisition of all or a portion of our business.
  • With your consent: we may disclose your Personal Information for any other purpose with your consent.
 

Your Right to Withdraw Consent

You may exercise certain rights regarding your information processed by us. In particular, you have the right to do the following: (i) you have the right to withdraw consent where you have previously given your consent to the processing of your Personal Information; (ii) you have the right to object to the processing of your Personal Information if the processing is carried out on a legal basis other than consent; (iii) you have the right to learn if information, including Personal Information, is being processed by us, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information, Personal Information, undergoing processing; (iv) you have the right to verify the accuracy of your information, including Personal Information, and ask for it to be updated or corrected; (v) you have the right, under certain circumstances, to restrict the processing of your information, including Personal Information, in which case, we will not process your information, nor your Personal Information for any purpose other than storing it; (vi) you have the right, under certain circumstances, to obtain the erasure of your Personal Information; (vii) you have the right to receive your information, including your Personal Information, in a structured, commonly used and machine readable format. This provision is applicable provided that your information is processed by automated means and that the processing is based on your consent, on a contract which you are part of or on pre-contractual obligations thereof. However, should you exercise any of your rights above, you are advised that this will disable part or all of the Services we are able to provide you with through the App, and we take no responsibility for the disabling of the Services or part thereof, resulting therefrom.
 

The Right to Object to Processing

Where Personal Information is processed for the public interest, in the exercise of an official authority vested in us or for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a ground related to your particular situation to justify the objection. You must know that, however, should your Personal Information be processed for direct marketing purposes, you can object to that processing at any time without providing any justification. To learn whether we are processing Personal Information for direct marketing purposes, you may refer to the relevant sections of this document. However, should you exercise any of your right above, you are advised that this will disable part or all of the Services we are able to provide you with through the App, and we take no responsibility to the disabling of the Services or part thereof, resulting therefrom.
 

Retention of Your Personal Information

We will retain your Personal Information only for as long as is necessary for the purposes set out in this Policy and/or Services. We will retain and use your Personal Information to the extent necessary to comply with our contractual obligations (for example, to perform the contractual obligations towards your employer in connection with which the App is being used by you, and in connection with which, the username and password was allocated to you) and/or to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Service, or where we are legally obligated to retain this data for longer time periods.
 

Transfer of Your Personal Data

Your information, including Personal Information, is processed and may be shared with third parties who are contracted by us. Accordingly, you hereby acknowledge and confirm that such information may be transferred to — and maintained on — computers located outside of your place of residence, where the data protection laws may differ than those in your jurisdiction.
 
Your consent to this Policy followed by your submission of such information represents your agreement to that transfer.
We take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy and no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other Personal Information.
 

Cookies

We may also gather certain technical information automatically and store it in log files, and use "cookies" and other similar technologies in providing the Services to you. Cookies and other similar tracking technologies (such as web beacons, pixel tags, scripts, tags, etc.) allow us to collect information about our users, their devices, and their online behavior automatically, which we can then use to enhance your navigation on the App, improve our Services, personalize your user experience, and collect statistics about user preferences, behavior, etc., and administer a variety of other analytical tasks.
A "cookie" is a small piece of information that is assigned to your Device while you enter the App. Cookies can be used for a variety of purposes, such as allowing you to navigate between pages efficiently, enabling automatic activation of certain features, remembering your preferences, and making the interaction between you and the App and/or Services quicker and easier. Aside from session cookies, which expire when you close the App, our App also uses such persistent cookies as Google Analytics and Facebook pixel.
You may disable cookies by following the instructions of your browser and/or Device preferences; however, if you choose to disable cookies, some features of our App and/or Services we offer may not operate properly and your online experience may be limited.
 

Delete Your Personal Information

You have the right to delete or request that we assist in deleting the Personal Information that we collected about you.
Our Service may give you the ability to delete certain information about you from within the App and/or Service.
You may update, amend, or delete your information at any time by signing into your Account, and visiting the Account settings section that allows you to manage your Personal Information. You may also contact us to request access to, correct, or delete any Personal Information that you have provided us.
Please note, however, that we may need to retain certain information when we have a legal obligation or lawful basis to do so.
 
Disclosure of Your Personal Information

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, your Personal Information may be transferred. We will provide notice before your Personal Information is transferred and becomes subject to a different Privacy Policy.
 

Law enforcement

Under certain circumstances, we may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
 

Other legal requirements

The Company may disclose your Personal Information in the good faith belief that such action is necessary to:
  • Comply with or contractual obligations with your employer, in connection with which the App is used by you, and in connection with which, the username and password is allocated to you
  • Comply with a legal obligation
  • Protect and defend our rights or property
  • Prevent or investigate possible wrongdoing in connection with the App and/or Service
  • Protect the personal safety of other users of the Service or the public
  • Protect against legal liability
 

Security of Your Personal Information

The security of your Personal Information is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
 

Children's Privacy

Our App and Service is not aimed nor should be accessed and/or used by minors under the age of 18, or such other age if lower or higher in your applicable jurisdiction. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, we ask that you contact Us. If we become aware that we collected Personal Information from anyone under the age of 18 without verification of parental consent, we take steps to remove that information from our servers and custody.
If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent's consent before we collect and use that information.
 

Links to Other Websites

Our App and Service may contain links to other application and/or websites that are not operated by us. If you click on a third-party link within the App, you will be directed to that third party's application/website. We strongly advise you to review the privacy policy of every application/website you visit.
Without derogating in any way from the generality of the paragraph immediately above, the App and/or Services may provide functionality allowing you to make payments using third-party payment services. When you use such a service to make a payment to us, your Personal Information will be collected by such third party and not by us, and therefore is subject to the third party’s privacy policy, and not this Policy.
We have no control over, and are not responsible for, this third-party’s collection, use, and disclosure of your Personal Information.
 

Changes to this Policy

We may update the Policy from time to time. We may, but do not guarantee that we will let you know of any change and/or update to this Policy.
Therefore, you are advised to visit this page on a regular basis.
Changes and/or updates to this Policy shall come into effect as soon as they have been posted by us on this page.
